Repairing harm

(Bài đọc tự viết; chương trình và nhân vật là giả định.)

A For most of modern history, the response to crime has been organised around a single question: what punishment does the offender deserve? Restorative justice starts from a different question: what harm has been done, and how can it be repaired? In a typical restorative meeting, an offender who has admitted responsibility meets the person they have harmed, usually with a trained facilitator. The victim can describe the effect of the offence, ask questions, and have a say in what the offender should do to make amends.

B It is often argued that such meetings are a soft option – a way of letting offenders avoid proper consequences. I think this misunderstands what actually happens in them. Many offenders describe facing the person they harmed as far more difficult than appearing in court, where they can remain silent while lawyers speak on their behalf – and I see little reason to doubt them. Accountability, in this sense, is not the same as suffering; it means being required to understand and answer for what one has done.

C Supporters also claim that restorative approaches reduce reoffending. The evidence here is more mixed than enthusiasts sometimes suggest. Some evaluations have found encouraging results, particularly for certain types of offence, while others have found little difference compared with conventional sentencing. It would be fair to say that restorative justice can reduce reoffending in some circumstances, but not that it reliably does so in all of them.

D What is clearer, in my view, is its value for victims. The conventional system tends to treat victims mainly as witnesses: they may give evidence, but they are rarely asked what they need. Victims who take part in restorative meetings frequently report that they feel less afraid and better able to move on, often because they finally receive answers to questions that had troubled them – Why me? Will it happen again? This benefit is sometimes overlooked in debates that focus only on offenders.

E There are, however, genuine limits. Participation must be voluntary for both sides; a victim who feels pressured into meeting an offender may be harmed a second time. Restorative meetings are also unsuitable when the offender denies responsibility, or when there is a serious imbalance of power between the two parties. Critics are right to insist on these safeguards, and any programme that ignores them deserves the criticism it receives.

F A further concern is consistency. Two offenders who commit similar crimes may reach quite different agreements depending on what their victims ask for. Some lawyers believe this undermines the principle that the law should treat people equally. I find this objection more persuasive than the “soft option” argument, although I suspect it can be reduced by setting clear limits on what any agreement may require, so that outcomes remain proportionate.

G Consider a hypothetical case. A teenager, Sam, damages a neighbour’s car. In a conventional process, he might receive a fine that his parents pay. In a restorative meeting, the neighbour explains that she relies on the car to take her mother to hospital appointments, and Sam agrees to work on weekends at a local garage until the repair is paid for. Whether this is “better” depends on what we want the system to achieve. If the aim is mainly to punish, the fine may be sufficient. If it is to make Sam understand the consequences of his actions, the second outcome seems more likely to succeed.

H None of this means that restorative justice should replace the courts. For many serious offences, and whenever the facts are disputed, a formal trial remains essential. The more modest claim – and the one I would defend – is that it deserves a regular place alongside conventional sentencing, offered carefully and only where both parties freely agree.

  9. 9. Restorative justice should eventually replace formal trials for most offences.

✅ Câu 10–13: chọn A, B, C hoặc D

  1. 10. In paragraph B, how does the writer redefine 'accountability'?

  2. 11. What is the writer's view of the evidence on reoffending?

Cấu trúc Chức năng
It is often argued that… tường thuật ý kiến phổ biến, chưa đánh giá
Supporters also claim that… ý kiến của một nhóm – claim cho thấy còn tranh cãi
It would be fair to say that… but not that… tác giả tự giới hạn kết luận
Critics are right to insist on… tác giả đồng ý một phần với phe phản đối
The more modest claim – and the one I would defend – is… lập trường cuối cùng
